TERMS AND CONDITIONS FOR THE ASSOCIATION OF GOLF MERCHANDISERS (AGM)

Terms of Use Agreement
Please read this Terms of Use Agreement carefully. It applies to your use of the online services
and digital products of the Association of Golf Merchandisers (“AGM,” “we,” or “us”), including
the AGM website located at agmgolf.org and all related subdomains (collectively, the “Sites”),
mobile applications, and all associated features, content, products, and services.
These include, but are not limited to:
• educational programs
• webinars
• CRM certification materials
• membership directories
• blogs and publications
• scholarship information
• downloadable resources
• conference and event materials
(collectively referred to as the “Services”).
Your use of the Sites and Services is governed by this Agreement regardless of how you access
them.
1. Acceptance of Terms
The Sites and Services are made available by AGM subject to this Agreement.
AGM reserves the right to modify or update this Agreement from time to time. Notice of
changes may be provided by posting the updated Agreement on the Sites.
Your continued use of the Sites or Services after changes are posted constitutes your
acceptance of the revised terms.
BY ACCESSING OR USING THE SITES OR SERVICES, YOU CONFIRM THAT YOU ARE OF LEGAL AGE
TO ENTER INTO THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS.
2. Membership Categories and Services Information
AGM provides members and users access to educational content, professional development
programs, networking opportunities, and industry resources related to golf retail.
Services may include:
• membership benefits specific to your category
• educational webinars and courses
• AGM Retail Conference and related materials
• CRM (Certified Retail Manager) certification program
• scholarship programs
• networking opportunities and directories
• industry news and publications
• community forums
AGM does not guarantee uninterrupted access to content and makes no warranties regarding
availability.
Content provided through AGM is intended for informational purposes only and does not
constitute legal, financial, or professional advice.
AGM EXPRESSLY DISCLAIMS LIABILITY FOR ACTIONS TAKEN OR NOT TAKEN BASED ON
INFORMATION PROVIDED THROUGH THE SITES OR SERVICES.
3. Membership Terms and Obligations
3.1 Membership Categories
AGM offers several membership categories including but not limited to:
• Merchandiser Members
• Vendor Partner Members
• Student Members
• Sales Representative Members
Each category may have specific eligibility requirements and benefits as described on the AGM
website.
3.2 Membership Dues, Billing, and Automatic Renewal
AGM memberships may be offered on either a monthly or annual billing cycle, depending on
the membership option selected during registration.
By purchasing an AGM membership, you authorize AGM to charge the applicable membership
dues to the payment method provided.

Membership dues are non-refundable except where required by law.
Billing Cycle
Membership billing operates as follows:
Monthly Memberships
Monthly memberships are billed once per month on the same calendar date as the original
purchase date.
Annual Memberships
Annual memberships are billed once per year on the anniversary of the original membership
purchase date.
Membership benefits remain active for the duration of the applicable billing period unless
terminated according to these Terms.
Automatic Renewal Authorization (Monthly Pay Members)
Unless cancelled prior to the renewal date, AGM monthly memberships automatically renew at
the end of each billing period.
By enrolling in membership, you authorize AGM to automatically charge the payment method
on file for the applicable membership dues at each renewal period.
Automatic renewals will continue until cancelled by the member or terminated by AGM.
Membership Fee Changes
AGM reserves the right to adjust membership dues from time to time.
If dues change, the updated pricing will apply beginning with the member’s next renewal
period.
Members will receive advance notice of any pricing changes prior to renewal.
Continued membership following renewal constitutes acceptance of the updated membership
dues.
Cancellation
Members may cancel their membership at any time by contacting AGM or cancelling through
their membership account.
Membership dues are not prorated and are non-refundable once processed, except where
required by law.
Employment Changes
AGM memberships belong to the individual member, not the member’s employer or golf
facility.
Membership remains active for the duration of the membership term regardless of changes in
employment, club affiliation, or geographic location.
If an employer pays membership dues on behalf of a member, such payment does not transfer
ownership of the membership to the employer.
AGM will not issue refunds or prorated credits if a member changes employment during the
membership period.
Members are responsible for updating contact and billing information if employment
circumstances change.
Employer Reimbursement
Many AGM members receive reimbursement for membership dues from their employer or golf
facility.
AGM will provide payment receipts; however, members are responsible for submitting
reimbursement requests to their employer.
AGM is not responsible for reimbursement decisions made by a member’s employer.
If an employer declines to reimburse membership dues after payment has been processed,
AGM will not issue refunds.
Termination by AGM
AGM reserves the right to suspend or terminate membership if a member:
• violates these Terms
• engages in conduct detrimental to AGM or its members
• fails to meet membership obligations
Termination decisions will be made at the discretion of the AGM Board of Directors and/or the
Chief Executive Officer.
4. Jurisdictional Issues
The Sites and Services are controlled and operated by AGM from the United States.
Users accessing the Sites from outside the U.S. do so at their own risk and must comply with
applicable local laws.
5. Information Submitted Through the Sites
Information submitted to AGM must be accurate and complete.
Use of submitted information is governed by AGM’s Privacy Policy.
6. Rules of Conduct
Users must comply with all applicable laws when using AGM Sites and Services.
Prohibited actions include:
• harassment or discrimination
• fraudulent activity
• unauthorized advertising
• scraping or data mining
• copying or redistributing content without permission
AGM may terminate access for violations.
7. Registration and Account Security
Users may be required to create accounts.
You are responsible for maintaining the confidentiality of your login credentials and all activity
under your account.
8. Forums and Community Areas
AGM may provide discussion forums or community features.
AGM does not guarantee accuracy of user-generated content.
Users participate at their own risk.
9. User Submissions
By submitting content to AGM, you grant AGM a worldwide, royalty-free license to use that
content for promotional, educational, or informational purposes.
10. Event Photography and Recordings
By attending AGM events, you grant permission for AGM to capture and use photographs,
video, or audio recordings for promotional and educational purposes.
11. Intellectual Property
All content on AGM Sites and Services is protected by copyright, trademark, and other
intellectual property laws.
Users may not reproduce or distribute content without permission.
12. Transactions
AGM may offer services or products including:
• membership dues
• event registrations
• educational courses
• CRM certification programs
AGM reserves the right to refuse or limit transactions.
Refund policies will be communicated at the time of purchase.
13. Third-Party Content
AGM is not responsible for content provided by third parties linked through the Sites.
14. Disclaimer of Warranties
THE SITES AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
15. Limitation of Liability
AGM SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
AGM’s maximum liability is limited to the amount paid for the membership or service in
question.
16. Indemnification
Users agree to indemnify AGM against claims arising from use of the Sites or Services.
17. Termination
AGM may terminate access to the Sites or Services at any time for violations of these Terms.
18. Governing Law
This Agreement is governed by the laws of the State of Arizona.
Disputes will be resolved through binding arbitration in Phoenix, Arizona.

21. Miscellaneous
This Agreement constitutes the entire agreement between the user and AGM regarding the
Sites and Services.
If any provision is deemed unenforceable, the remaining provisions remain valid.
AGM will not be responsible for delays caused by circumstances beyond its control.
